Makaw PDF Terms of Service

Welcome to Makaw PDF. The following Terms of Service ("Terms") govern your access to and use of the Makaw PDF application and website (hereinafter, "the Application" or "the Service"), a product developed by Makaw Dev.
By downloading, accessing, or using the Application, you agree to be legally bound by these Terms. If you do not agree to any of the terms set forth herein, you must not use the Service.
1.Description of the Service and Execution Environment
Makaw PDF provides a suite of software tools for PDF file manipulation (including, but not limited to, merging, splitting, compressing, protecting, and unlocking). The Application is designed with a 100% local processing architecture ("Zero Cloud"). This means that file processing consumes the resources (memory and CPU) of the user's device. Makaw Dev does not host, endorse, or have access to any documents processed through the Service.
2.License to Use
Makaw Dev grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided as part of the Service. This license is for the sole purpose of enabling you to use and enjoy the benefits of the Service as provided by Makaw Dev, in the manner permitted by these Terms. You may not reverse engineer, decompile, or attempt to extract the source code of the Application.
3.Content Responsibility and Fair Use
Since the Application operates strictly locally, you are solely responsible for the content of the files you process.
Protected Files: By using the "Unlock" tool, you represent and warrant that you possess the legal rights or explicit authorization from the document owner to remove safety restrictions from the PDF file.
Makaw Dev is not liable for the improper use of the tools to alter contracts, forge documents, circumvent copyrights, or any other illegal activity.
4.Intellectual Property
All right, title, and interest in and to the Application (excluding user-provided content), including its design, user interfaces, logos, and underlying code, are and will remain the exclusive property of Makaw Dev.
5.Disclaimer of Warranties ("As Is" Clause)
The Service is provided "as is" and "as available". Makaw Dev makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Application. Although we have designed the software under high engineering standards, we do not warrant that the use of the Application will be uninterrupted or error-free. We strongly recommend that you maintain backups of your original documents before processing them.
6.Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Makaw Dev or its developers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, loss of data (including corruption of local PDF files or loss of encryption passwords), or other intangible losses resulting from your use of or inability to use the Application.
7.Modifications to the Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
8.Applicable Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Puerto Asís, Putumayo, Colombia.
